Applicants and representors have rights of appeal to the Tasmanian Civil and Administrative Tribunal (TASCAT). Appeals must be lodged within 14 days with the relevant fee.

Who can appeal

  • The applicant can appeal a request for additional information, a decision, or any particular condition on a permit.
  • A representor can appeal against a condition or a decision.

Where appeals are lodged

All planning appeals are lodged with the Tasmanian Civil and Administrative Tribunal (TASCAT). You have 14 days from the decision to lodge, and the relevant TASCAT fee must accompany the appeal.

What happens during an appeal

If an appeal is lodged, the planning permit does not become valid until the appeal is resolved. TASCAT will run the appeal process — if you’re a party to the appeal, follow TASCAT’s directions and timeframes carefully. Council planning officers can answer questions about the application but cannot give legal advice on the appeal itself.
